Realtors as Board Members of Homeowner Associations

The question is often asked as to whether Realtors may serve as members of their board of directors.

The answer is yes, they may serve as directors, but like all directors, they must avoid conflicts of interest and even the appearance of conflicts of interest. Consequently, Realtors should not solicit real estate related businesses, from homeowners or renters while serving on the board of directors of their homeowner association.

The most common example of a conflict of interest is when a Realtor serving on a board wants to spend funds on cosmetics that will help sales in the short term while ignoring more important matters such as plumbing and roof repairs.
