Attorneys at Hearings – Violation of CC&Rs and/or Rules

Owners who are requested to attend a hearing concerning an alleged violation of the CC&Rs and/or Operating Rules, do not have a right established by California law to be represented by an attorney, Unless such a right is included within the governing documents of the association, attorneys may not be present to represent a member of the association, This is not a right that most developers include in governing documents they create when forming a common interest development.
